Overview
If someone can credibly demonstrate a legitimate or legal interest, he or she may be provided with the following data of a specific individual resident in addition to simple information from the population register:
- Date and place of birth
- Former first names and surnames
- Marital status, limited to whether married or not
- Surname and first names and address of the spouse or life partner
- Nationality
- Previous addresses
- Date of moving in and out
- Legal representative
- Date and place of death
The registration authority must immediately inform the person concerned about the provision of extended information from the population register, stating the data recipient (information is not provided if the existence of a legal interest has been substantiated).
Information from the population register to private individuals for the purpose of advertising and/or address trading is only permitted if the citizen has previously consented to the transfer of their registration data for these purposes. This consent must be expressly declared to private individuals. If no consent has been given, the registration authority may not disclose the registration data for the purpose of advertising and/or address trading.
In addition, data that has been collected for the purpose of commercial address research by means of a registration register inquiry may not be reused by the data recipient (prohibition of data pooling). The improper use of earmarked population register information or the reuse of the data can be punished with a fine.
Furthermore, the commercial purpose must be stated in the context of an extended information request for commercial purposes. The data obtained as part of the information may then only be used for these purposes.
There is also a strict purpose limitation for so-called extended civil register information and for data that has been obtained despite the existence of an information block, because a risk to the person concerned can be ruled out. Once the purpose pursued in each case has been fulfilled, the data recipient must delete the data.
Extended information from the register of residents can only be provided in writing and accompanied by the relevant evidence.
